Victim reported taking pills before alleged assault on Marco

A Marco Island resident accused of sexual battery on a 16-year-old Naples girl was released on $70,000 bail.

Fabian E. Eiben, 47, of 770 Inlet Drive, Marco Island, was arrested Oct. 25 on charges stemming from an incident that allegedly occurred between 11 p.m., Oct. 23 and 3:45 a.m., Oct. 24.

Eiben’s occupation is listed as “car exporter” on an arrest report, which also states that he is self-employed. The girl’s identity is being withheld both because of the nature of the allegations and her status as a minor.

Notes on the arrest report state that the victim said she was alone with a man named Fabian at the Inlet Drive home at that time, when he gave her beer and a pill he said was ecstasy. According to the report, the girl said the man also offered her other pills, but she could not recall taking them.

According to the report, the girl told police she believed she passed out and that the man had sex with her without her consent. In the report, Eiben denies any sexual activity took place, and apparently told police he only gave the girl Unisom, a sleep aid.

When she woke up, the report states, she allegedly saw a video camera and viewed footage of herself, naked, crawling and licking the floor, as well as a close-up of her own dilated eyes.

She told police that she did not give the man permission to film her naked, the report states.

The girl was examined at Planned Parenthood by a nurse practitioner, according to the report, and Marco Island Police Detective Linda Guerrero investigated the complaint Oct. 24 at 9:15 p.m.

Eiben was arrested at 8:40 a.m. Oct. 25 by Marco Island Police, and charged with sexual battery, unlawful sexual activity with a minor 16 or 17 years of age, prohibition of certain acts in connection with obscene, lewd materials and two counts of distribution or dispensation of a controlled substance. All are felony charges.

Marco Island Police Chief Roger Reinke said police also conducted a search of Eiben’s home for evidence, and the report states that Eiben provided a buccal swab, or cheek swab, for DNA testing once taken to the police department. He was later taken to Collier County Jail.

His arraignment is scheduled for Nov. 11.

This is gross... He admitted to giving her a sleeping pill, and we are supposed to believe that there wasn't a ulterior motive? Give me a break. This guy is a sicko.

If these allegations were true, I would agree. However, when the facts come out and this is dismissed he is entitled to vindication. You know NOTHING of the facts of this case at all. I can assure you of that. And, no one wants to question why a 16 year old girl who was living with a 40 year old man anyway, is out all night? Is it possible for one minute that she has rescinded her accusations? Is it possible that she is no where to be found? Is it possible that she has done this twice before? God help anyone that this happens to.

As for "accurate reporting", the Eagle staff can't even report an arraignment date right: November 11 is a Sunday.
